1. Agreement to These Terms

These Terms of Use ("Terms") govern your access to and use of www.xrayfilmsdisposal.com and any related pages, forms, and content (the "Site"), operated by B.W. Recycling, Inc., doing business as X-Ray Films Disposal ("we," "us," or "our"). By accessing or using the Site, you agree to these Terms. If you do not agree, do not use the Site.

2. Our Services

The Site provides information about our X-ray film recycling, disposal, and silver recovery services, and lets you request quotes, pickups, and mail-in service. Any pickup, purchase, or disposal of materials is governed by the quote, order confirmation, or service agreement issued for that transaction. If those documents conflict with these Terms, those documents control for that transaction.

3. Permitted Use

You may use the Site for your own lawful, non-commercial informational purposes and to do business with us. You must be at least 18 years old, or the age of majority where you live, to submit requests through the Site.

4. Prohibited Use, Including Automated Access and Data Collection

You agree not to, and not to permit or assist anyone else to:

  • Use any robot, spider, crawler, scraper, script, browser extension, or other automated means or manual process to access, monitor, search, copy, extract, or collect any content or data from the Site, except for general-purpose search engines indexing the Site for public search results in compliance with our robots.txt file.
  • Compile, create, or maintain any collection, compilation, database, directory, or dataset using content or data obtained from the Site, whether for internal use, resale, lead generation, price comparison, or any other purpose.
  • Copy, reproduce, republish, frame, mirror, or redistribute any part of the Site, including our pricing, service descriptions, location pages, and text, without our prior written consent.
  • Use content from the Site to train, fine-tune, or develop any machine learning or artificial intelligence model, or to build a competing product or service.
  • Circumvent, disable, or interfere with any security feature, rate limit, access control, or technical measure we use to protect the Site or restrict access to it.
  • Submit false, misleading, or automated information through our forms, or impersonate any person or organization.
  • Upload or transmit viruses, malicious code, or anything that could damage, disable, overburden, or impair the Site or our servers.
  • Use the Site in violation of any applicable law or regulation.

We may monitor traffic to the Site and may block, limit, or suspend access by any person, IP address, or automated agent at our sole discretion and without notice.

5. Intellectual Property

The Site and its content, including text, graphics, logos, photographs, page layouts, pricing information, and the selection and arrangement of that content, are owned by or licensed to B.W. Recycling, Inc. and are protected by copyright, trademark, and other laws. Except for the limited permission in Section 3, no right or license is granted to you. "X-Ray Films Disposal" and our logos are our trademarks and may not be used without our written permission.

6. Quotes, Pricing, and Information Accuracy

Prices, payout rates, and service details shown on the Site are for general information, may change without notice, and are not binding offers. Final pricing depends on the actual materials received, their weight, silver content, and condition, and is confirmed in your quote or settlement. We try to keep the Site accurate but do not guarantee that all information is complete or current.

7. Information You Submit

When you submit information through the Site, you confirm it is accurate and that you are authorized to submit it. Our handling of personal information is described in our Privacy Policy. Do not submit patient health information through Site forms; protected health information contained in films is handled under our separate disposal procedures and agreements.

8. Third-Party Links

The Site may link to third-party websites. We do not control and are not responsible for their content, policies, or practices. Your use of those websites is at your own risk.

9. Disclaimer of Warranties

THE SITE AND ITS CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, B.W. RECYCLING, INC. AND ITS OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SITE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US $100). This section does not limit liability under any separate service agreement for materials we collect or process.

11. Indemnification

You agree to indemnify and hold harmless B.W. Recycling, Inc. and its officers, employees, and agents from any claims, losses, damages, and expenses, including reasonable attorneys' fees, arising from your violation of these Terms or your misuse of the Site.

12. Enforcement and Remedies

Any use of the Site in violation of Section 4 is unauthorized access and may cause us irreparable harm for which money damages are not an adequate remedy. In addition to any other remedies, we may seek injunctive relief without posting a bond, recover our costs and reasonable attorneys' fees, and pursue any remedies available under applicable law, including laws governing computer misuse and unauthorized access.

13. Governing Law and Venue

These Terms are governed by the laws of the State of Texas and applicable U.S. federal law, without regard to conflict-of-law rules. Any dispute arising from these Terms or the Site will be brought exclusively in the state or federal courts located in Texas, and you consent to their jurisdiction.

14. Changes to These Terms

We may update these Terms at any time by posting the revised version on this page with a new "Last updated" date. Your continued use of the Site after changes are posted means you accept the updated Terms.

15. General

If any provision of these Terms is found unenforceable, the remaining provisions remain in effect. Our failure to enforce any provision is not a waiver of it. These Terms, together with our Privacy Policy, are the entire agreement between you and us regarding the Site.
